Cannabis has been part of the fold in California for years. The state legalized medical marijuana in 1996 and, a decade later, followed by legalizing the use of recreational marijuana as well. Since marijuana and hemp are closely related, it only seems applicable to be able to find CBD oil for sale in California dispensaries, but it’s a little bit more convoluted than that.
Are hemp and cannabis the same thing?
Well, yes and no. Hemp, just like marijuana, is a member of the cannabis plant family. The difference lies in the active chemicals. Marijuana is known to produce highs that are the result of THC, while hemp plants are characterized by THC content that falls below 0.3%. CBD won’t get you high, but the plentiful capacity of CBD makes it useful in its own right.
The other main difference between the two is the legal standing. Hemp was recently removed from the list of Schedule I drugs by the federal government, allowing each state to implement their own laws around growth, sale, and consumption of hemp products. Marijuana is still classified as a Schedule I drug on the federal level, and only select states, like California, have legalized it in their borders.
Does California allow hemp products in dispensaries?
Hemp’s new-found freedom would seemingly make it a shoo-in for California dispensaries. It isn’t quite so clear cut, and there are some other lawful discrepancies, namely, Proposition 64, that still need to be addressed.
As a somewhat strange byproduct of legalizing marijuana, Prop. 64, or the Adult Use of Marijuana Act, banned hemp-derived CBD oil for sale in California. CBD is only legal so long as it is made from marijuana.
Will CBD from marijuana induce a high?
Hemp-derived CBD is ideal for most consumers since there is a stronger guarantee of not coming into contact with federally-illicit THC. Because of the limitations on hemp, you won’t be able to find CBD oil for sale in California that’s not made from marijuana.
There are plenty of reasons why people would want to avoid THC. Whether it’s the an anticipation of work-mandated drug testing or just a personal distaste for the THC high, hemp is a safer bet for CBD without side effects.
